we were shooting our markers in my coaches back yard when a cop came and told us it was illigal, he didnt try to confiscate the markers though

I never openly shoot my marker in my yard. I stand inside the shed in my back yard and shoot out the door at a huge tree about 100 feet away. This way none of my neighbors can see me or the marker. Although the kids across the street will run all over the neighborhood shooting airsoft guns at each other and nobody ever complains. lol. Grenades and landmines are a different story. I'm always blowing something up in the back yard. There's usually paint everywhere until it rains. lol

I am itching to know what happened? have you talked to the police yet? Have you gotten your Phantom back?

Unfortunately, when your in an Urban or Suburban area, the definition of Firearm changes. I live in the country and the police told me that out here a fire arm is "Anything that fires a projectile by explosion/combustion" Which means that you were right, but you were in the city. When I got my airsoft gun confinscated, I was really confused when he said "You cant discharge firearms in Suburban areas" So I asked him what the definition of Firearm meant in a suburban area. This is the Police definition:
A firearm can be anything that shoots a projectile that could potentially harm someone or ricochet and harm someone, this also includes arial fireworks

So, really, you had the definition right, just not for where you live. Next time, ask your neighbors if you can shoot a few shots and explain to them that you aren't shooting a real "gun". Thats what I did, and now my neighbors come over and shoot sporting clays with 12 guages with me! :laugh:

If your neighbors know what your doing, and they know that you cant hurt anyone (technically), then the only reason they would call the cops is because its annoying. :dry:

Sadly i think you're not going to win this fight...the language is fairly ambiguous. When you read it as a paintball player it may seem that it was all safe and not endangering someone...but then again as paintball players we know when someone has the potential to get hurt. But the "air-gun or other weapon" and "any place..." is basically leaving it up to the officer to interpret it. And if the officer doesn't know anything about paintball and was doing it to appease a (i assume) very nasty complaint...well then it's bye-bye phantom. I've had friends that have had this happen both ways...it's all up to the officer.

but i agree that calmly (do NOT play the victim) going to talk to the officer in charge and explaining it all will get your phantom back. remember, you're not there to debate the laws, you're there to get your property back...and figure out exactly how they interpret this law. ask questions...don't accuse.

oh, and annoying your neighbor by firing it loudly in your garage will just get a noise complaint called on you...then it's a fine, another trip to the PD...and now you have a reputation. take the higher road.

i live in the middle of the city, i shoot from my apartment window at a street light. Probly not legal but i make sure there are no cars coming or people walking accross the street.

That's a quick way to get a lot of people to hate you... I'd really suggest stopping it for the sport's reputation and those who play it.

That and people that do drive by's with a marker shooting road signs. That really gets to me...

Well I know here it's illegal to fire ANY Airsoft gun within city limits. So i am guessing it's the same for paintball. Kinda sucks though bud. I ALWAYS no matter how much I wanna shoot in my backyard, shoot my marker on my buddies farm. Save's me the hassle of cops and neighbors and such.

Update:
It really seems like the police are giving me the runaround in my attempts to get my marker back. I've talked to the property clerk, and basically she said that she needed to confirm it with the officer that made the confiscation before it could be released. He's on vacation for another three days. So tonight I'm going to try and talk to his commanding officer and see if he can give the go ahead to get it picked up.

Well if he was, he'd probably soon realize that there's no danger in hitting anything except what you're aiming at - it shoots darts!

1st off, no they don't.
2nd, do you know what the definition of "sport" is? Sport: (1)a physical activity engaged in for pleasure (2): a particular activity (as an athletic game) so engaged in.

Must be some state or city level laws, because there are no such things at the federal level.

Anyway, the definition a paintball marker falls in will vary from location to location. Most places that have "air gun" type rules that differ from a firearm will place a marker in that category.
