A man who told a judge he makes his living off eBay had his vocation cut short this week after he tried to sell a stolen cell phone testing device on the Internet auction site, authorities said.

East Dundee police say the equipment was taken during a vehicle burglary last month in the village.

Brian C. Russell, 26, of Chicago, was charged with two counts of felony theft. He is accused of trying to hawk a Measurement Receiver Cellular Tester on eBay.com when he knew the device was stolen, police said. The machine is used to measure the signal strength of cell phones, according to police. The expensive measurement receiver Russell allegedly posted for sale was reported stolen on Valentine's Day weekend from a Cricket Communications wireless phone carrier vehicle.

Police began an investigation of Russell after an employee with Cricket Communications spotted a measurement receiver for sale on eBay that had the same serial number as the stolen equipment, police said.

The signal measuring device reportedly is worth about $35,000 but was listed for sale by Brian Russell Inc. at $17,500, police said. The eBay post also included photos and other identifying information that led police and Cricket Communications to believe that the item for sale was the missing equipment, police said.

Police set up an undercover operation, and an officer posed as a potential buyer. The officer arranged to meet Russell to inspect and test the equipment in person and, when Russell showed up with the stolen receiver, he was arrested, police said.

Although Russell has been charged with two counts of theft, police are still investigating whether he is the person who actually removed the equipment from the Cricket Communications vehicle in February, East Dundee Police Chief Terry Mee said. The theft charges against Russell stem from authorities' belief that Russell knew he was selling stolen goods, Mee said.

Russell's bail was set at $15,000 in Elgin bond court on Monday.

When the judge asked Russell what the 26-year-old did for a living, Russell replied, "I sell stuff on eBay."

"You sell stuff on eBay and you have been arrested for that -- an interesting coincidence," Judge Bruce Lester replied.

Each felony charge Russell faces carries a penalty of up to seven years in prison plus fines. He is to appear in court March 31.


kinda pisses me off how these people are using Ebay / craigslist to sell stolen stuff or Rob people. Technology being used against us..

I was robbed about 2 years ago and some very personal items along with family antiques were taken. I found about 3 months later some of the stolen items for sale on a local website called KSL.com. I ended up meeting with this person and received some of my items back with the help of the police. Stupid criminals, really!

we've had at least 6 craigslist robbery's within the past 2 months..

its ridiculous how people dont take the necessary precautions when they kno this kind of stuff happens

Just to update... I'm Brian Russell and I got the box from a guy who told me it was a modem. I'm a reseller, I buy things from thrift stores, garage sales, yard sales, estate sales, craigslist, flea markets, etc... I first contacted the company that makes the equipment where it came back clean and reported the retail value of $35,000. I almost cried tears of joy, so I posted it on ebay and I actually got an email letting me know that it was property of Cricket Wireless from a prospect who wanted the serial # so I contacted Cricket to ask if I could legally obtain it or return it for a finders fee. No reply, voice mails only... I called their parent company Leap Wireless 5 times that week and no response. I got a call from an ebay prospect who wanted to buy it immediately and I informed him that I could not sell it because I found out that it was property of Cricket. He told me that his boss didn't care and wanted it either way. I told him that he would have to wait and it would either be returned to them or I would legally obtain the license before allowing him to buy it. From there he said well can I at least test it... I agreed because I was curious myself. I didn't have the wires or antennas or even the software. After church my wife, my 4 year old daughter and I meet with the gentleman at a public location where he steps out of the vehicle, tells me I'm an officer and that I was going with him. I gave my wife my bag and my money. They drove right past the Chicago police station and told me that I was going to east dundee, a place i had never heard of until that moment. They didn't read me my rights or tell me that I was being arrested until we entered Kane County, around 40 mins later. My prints didn't match the vehicle and it turned out that the vehicle was never in east dundee, it was in Chicago. The crime was committed roughly 4 hours after I got it, which makes no sense either. Long story short, I never even talked to a judge. Case dismissed after 2 appearances. 1 to make sure I would show to retain bail and 1 to have them tell me that they it cost me $3,000 in legal fee's but my name is clear, of course they never follow up with these things. I have no criminal record. I'm an educational consultant, I help high school students with sat/act preparation, college placement and scholarship / grant acquisition for a non-profit. I also tutor preschooler's, teaching them letters and their sounds, introduction to reading, vocabulary, numbers, basic addition / subtraction, colors, shapes, motor skills, etc. I've worked for a non-profit no-kill animal shelter and have helped people quit smoking as a personal supporter just for a background on myself. I got a raw deal as a learning experience. I had never spent time in any jail before that event where I spent 2 hours in a dorm with a guy who was in there for attempted murder with a pistol, wreck less endangerment and dui. I used to buy things and re-sell them all the time but obviously you need to be weary of a deal that's just too good to be true.

Thank you for explaining the whole story and that stinks that you had to go through that, and that your name will always be tarnished by this story.

Just to let you know, the reason we found this funny is because the owner of this site and the affiliated store is also named Brian Russell. We have nothing against you personally.

In all honesty i hope you can eventually get that off of your back and you can continue your resale business.

And thank you for your time helping those students/preschoolers.

Our tattoo shop got robbed not too long ago. Robin and I were involved in a sting to buy it back. We held them until the cops could get across town.
